تطبيقات الاجتهاد المقاصدي في نوازل الأسرة -نماذج مختارة

Abstract

يُعدّ الاجتهاد المقاصدي من الموضوعات العلمية ذات الأهمية البالغة في الدراسات الشرعية؛ لما له من دورٍ فاعل في استنباط الأحكام الشرعية ومعالجة النوازل والقضايا المعاصرة في ضوء مقاصد الشريعة الإسلامية. ومن هذا المنطلق، جاءت هذه الدراسة في شقين: نظري وتطبيقي؛ حيث تناولت مفهوم الاجتهاد المقاصدي، مع بيان أبرز المسالك والضوابط التي يقوم عليها. كما سعت إلى إبراز أثر توظيف هذه الضوابط في معالجة المسائل الفقهية المعاصرة، وبيان دورها في تحقيق الفهم السليم للنصوص الشرعية والتنزيل الصحيح للأحكام على الوقائع المستجدة، بما ينسجم مع مقاصد الشريعة ويحقق مصالح المكلفين. الكلمات المفتاحية: المقاصد، الاجتهاد،المقاصد، النوازل الفقهية المعاصرة، الأسرة.

Abstract Maqasid-based Ijtihad (objective-oriented juristic reasoning) is regarded as one of the Most significant approaches in contemporary Islamic legal studies due to its pivotal role in deriving Sharia rulings and addressing emerging issues in light of the higher objectives of Islamic law. Accordingly, this research is divided into two chapters: a theoretical chapter and an applied chapter. It examines the concept of Maqasid-based Ijtihad and its importance in thelegal rooting and derivation of Sharia rulings, while highlighting the principal methodologies and regulatory principles upon which it is founded. Furthermore, the study explores the impact of applying these principles to contemporary jurisprudential issues and demonstrates their contribution to achieving a sound understanding of Islamic legal texts and the proper application of rulings to newly emerging realities. Ultimately, the research underscores the role of Maqasid-based Ijtihad in realizing the objectives of Sharia and promoting the welfare of individuals and society.
