النوازل الفقهية الخاصة بالنساء - نماذج مختارة -

Abstract

للقضايا الفقهية المعاصرة الخاصة بالنساء أحكام شرعية اهتم العلماء ببحثها والاجتهاد فيها. وتتمحور هذه الدراسة حول بيان الأحكام الشرعية لنماذج من النوازل الخاصة بالمرأة، ومن خلال هذا تم طرح الإشكال الآتي: ما هي الأحكام الشرعية المتعلقة بالنوازل الفقهية الخاصة بالنساء؟ وللإجابة على هذه الإشكالية تم تقسيم البحث إلى: مقدمة وفصلين: الأول: تعريف المصطلحات الأساسية للبحث. والثاني: دراسة النماذج المختارة من النوازل الخاصة بالنساء. وقد جمعت الرسالة مسائل في باب العبادات في الطهارة،الصلاة، الصوم والحج، وجمعت في باب المعاملات مسائل في الخطبة،الزواج، الخلوة والاختلاط. وفي الختام تم التوصل إلى جملة من النتائج منها: أن النوازل الخاصة بالنساء متنوعة في باب العبادات وباب المعاملات والأحكام الشرعية المتعلقة بها منها ما هو متفق عليه ومنها ما اختلف في حكمه. Contemporary jurisprudential issues pertaining to women have legal rulings that scholars have been interested in researching and making jurisprudence in them. This study is centered on clarifying the legal rulings for a number of women-specific issues, and through this, the following question was posed: What are the legal rulings related to the jurisprudential issues related to women? In order to answer this question, the research was divided into: Introduction and two chapters: The first: Defining the basic terms of the research. The second: A study of selected models of women-specific nazl. The thesis collected issues in the section of worship in the areas of purity, prayer, fasting and pilgrimage, and in the section of transactions in the areas of betrothal, marriage, solitude and mixing. In conclusion, a number of conclusions were reached, including: The issues related to women are diverse in terms of worship and transactions, and the legal rulings related to them, some of which are agreed upon and some of which differ in their judgment.
