الشكلية في العقود الواردة على العقار

Abstract

باعتبار العقار ركنا أساسيا في التنمية الاقتصادية للدولة ومحط اهتمام الافراد باعتباره ثروة، اولاه المشرع الجزائري أهمية بالغة بوضعه للمحررات الواردة عليه جملة من الخصوصيات، أبرزها إحاطة هذه المحررات بالشكلية التي تمثل أساس تحرير العقود العقارية، بهدف توضيح حقوق الأفراد والجماعات والحفاظ عليها، كما حاول وضع حلول مناسبة لتنظيم الملكية العقارية من خلال آليات للشهر العقاري بدءا بالتسجيل ثم المسح وبعدها الشهر العقاري.
