Abstract

تتمتع اإلدارة العامة بسلطات واسعة بمناسبة أدائها لمهامها المختلفة بمقتضى ما تصدره من قرارات و ما تبرمه من عقود متنوعة و من أبرزها هي سلطة أو حق اإلدارة في تعديل شروط العقد و االلتزامات التعاقدية المنصوص عليها في طياته، و بالرغم من اختالف الفقهاء حول ثبوت هذا الحق إال انه أصبح اليوم من المبادئ المعترف بها لإلدارة العامة هذا األخير الذي يجد أساسه في فكرتين بارزتين هما امتيازات السلطة العامة التي تسعى لتحقيق المصلحة العامة و الثانية هي احتياجات المرافق العامة التي تعمل باستمرار و إطراد من أجل إشباع حاجيات الجمهور. الكلمات المفتاحية: اإلدارة العامة، تعديل القرار، الصفقات العمومية.

Abstract: The public administration enjoys broad powers in the performance of its various duties, as stipulated by the decisions it issues and the diverse contracts it concludes. One of the most prominent of these powers is the authority or the right of the administration to modify the terms of the contract and the contractual obligations specified within it. Although scholars differ on the affirmation of this right, it has become one of the recognized principles of public administration. This principle finds its basis in two prominent ideas: the privileges of public authority that aim to achieve the public interest, and the needs of public services, which continuously and consistently work to meet the needs of the public.
