دلالة الإشارة وأثرها في فهم آيات أحكام النساء دراسة تطبيقية في كتاب أحكام القرآن لابن العربي

Abstract

يُعنى هذا البحث الموسوم بـ: دلالة الإشارة وأثرها في فهم آيات أحكام النساء دراسة أصولية تطبيقية في كتاب أحكام القرآن لابن العربي ببيان مكانة دلالة الإشارة ضمن مباحث دلالات الألفاظ، والكشف عن أثرها في فهم النص القرآني واستنباط الأحكام المتعلقة بالمرأة، من خلال التطبيق على كتاب أحكام القرآن للإمام ابن العربي. وقد جاء البحث مشتملًا على تمهيد وفصلين؛ خُصِّص التمهيد للتعريف بدلالات الألفاظ عند الأصوليين، وبيان أنواع الدلالة، مع إبراز موقع دلالة الإشارة ضمن هذه المباحث الأصولية. أما الفصل النظري، فقد تناول حقيقة دلالة الإشارة من حيث تعريفها لغة واصطلاحًا، وبيان نوع الدلالة فيها وقوتها في الاستدلال، ثم عرض موقعها في تقسيمات الأصوليين، مع بيان مسلك الحنفية والجمهور في تناولها وبيان منزلتها بينهم. في حين خُصِّص الفصل التطبيقي للتعريف بالإمام ابن العربي وبكتابه أحكام القرآن، ثم دراسة طائفة من آيات أحكام النساء التي استنبط منها أهل التفسير الثقات أحكامًا بطريق دلالة الإشارة، مع بيان وجه الاستدلال بها، ومدى إسهام هذه الدلالة في توسيع آفاق الفهم والاستنباط للنص القرآني. وقد خُتم البحث بجملة من النتائج التي أبرزت القيمة الأصولية والتفسيرية لدلالة الإشارة، وما لها من أثر في استنباط الأحكام الشرعية، إلى جانب ذكر عدد من التوصيات والمقترحات المتصلة بموضوع الدراسة. الكلمات المفتاحية: دلالة الإشارة، أصول الفقه، دلالات الألفاظ، آيات أحكام النساء، أحكام القرآن لابن العربي، الفقه المقارن. Abstract This research, titled "The Implied Indication (Dalalat al-Isharah) and Its Impact on Understanding the Verses of Women’s Rulings: An Applied Usuli Study on 'Ahkam al-Qur'an' by Ibn al-Arabi," aims to clarify the status of Dalalat al-Isharah within the linguistic tracks of jurisprudence (Datalat al-Alfaz), uncovering its impact on comprehending the Qur’anic text and deducing (Istinbat) Sharia rulings related to women, through practical application on Imam Ibn al-Arabi’s book, Ahkam al-Qur'an. The study is structured into an introduction and two main chapters; the introduction is dedicated to defining text indications according to jurists (Usuliyyin) and outlining their types, while highlighting the position of Dalalat al-Isharah within these jurisprudential tracks. The theoretical chapter addresses the core nature of Dalalat al-Isharah regarding its lexical and technical definitions, its indicative nature, and its evidentiary weight in legal reasoning, in addition to mapping its placement within juristic classifications while showcasing the distinct approaches of both the Hanafi school and the Majority (Al-Jumhur). Meanwhile, the applied chapter is devoted to introducing Imam Ibn al-Arabi and his book, Ahkam al-Qur'an, followed by an analytical study of a selected group of Qur'anic verses concerning women's rulings from which authoritative exegetes extracted legal judgments via Dalalat al-Isharah, explaining the mechanism of legal deduction and demonstrating how this indication expands the horizons of understanding and deriving meanings from the Qur'anic text. Ultimately, the research concludes with a set of findings that emphasize the jurisprudential and exegetical value of Dalalat al-Isharah and its profound impact on deducing Sharia rulings, alongside presenting a series of recommendations and future research proposals related to the theme of the study.
