الحماية الدستورية للحقوق الساسية للمراة على ضوء الاصلاحات الجديدة

Abstract

اكتسب موضوع الحقوق السياسية للمرأة أهمية متزايدة خاصة في السنوات الأخيرة، إذ تطرح قضية المرأة كمشكلة اجتماعية عامة تهم كل المجتمع، بحيث تعبر المشاركة السياسية للمرأة في أي دولة من دول العالم عن المدى الحضاري الذي توصلت إليه هذه الدول، وقد أولى المشرع لهاته الحقوق أهمية كبيرة تبرز من خلال النص على حمايتها في القانون الأساسي(الدستور)، وما تبعه من صدور قوانين عضوية تجسد ذلك. ويتجلى تأثر المشرع الجزائري بالقانون الدولي من خلال مصادقته على أغلب المعاهدات والاتفاقيات الدولية المتعلقة بحقوق الإنسان بصفة عامة وحقوق المرأة بصفة خاصة، وهو ما يظهر بقيام المشرع الجزائري بتعديل أغلب القوانين التمييزية ضد المرأة. وقد كانت نسبة تمثيل المرأة في المجالس المنتخبة ضعيفة وكادت أن تكون منعدمة خاصة في المجالس المنتخبة المحلية، وذلك لاعتبارات عدة كالأمية، الفقر، الفهم السيئ للعادات والتقاليد، أما حاليا وباعتماد نظام الكوتا شهدت هاته النسبة تحسنا ملحوظا بحيث ساهم في رفع مستوى مشاركة المرأة في الحياة السياسية. Abstract The issue of political women rights has acquired an increasing importance specifically within the last few years. It is considered as a general social case that matters society. Thus, the political involvement of women expresses to which extent a country is civilized. In addition, the legislature has given these rights a great deal of interest through the insistence on protecting them in the principle canon of any country, which is the Constitution, and all the following Organic Laws. The Algerian legislature is affected by the international laws. This effect is noticed in the approval of almost all treaties and agreements about human rights in general and women rights in specific. Therefore, all the racist laws against female have been modified. To conclude, women’s representation in Elected Councils was so weak that the percentage was almost zero specifically within the local Councils due to many factors including illiteracy, poverty and misinterpretation of traditions and customs. Nowadays, the percentage has witnessed a considerable improvement thanks to Quota System that has contributed in the increase of women’s participation in the political life.
