Abstract

Summary
This research examines the contract of Ju'alah (reward-based contract) in Islamic jurisprudence and its contemporary applications. It explores its legal nature, pillars, conditions, and legitimacy, while highlighting the key differences between Ju'alah and other contracts such as Ijarah (leasing), Mudarabah (profit-sharing), and Istisna' (manufacturing contract). The research concludes that Ju'alah is a non-binding permissible contract based on offering a specified reward to anyone who performs a lawful task or achieves a specific result, regardless of whether the worker was previously aware of the reward. It is distinguished by not obligating the worker to perform the task, and the entitlement to compensation is based on achieving the result, not merely on exerting effort.
The research also traces some contemporary applications of Ju'alah, most notably: innovation and invention prizes, scientific research competitions, rewards for reporting crimes and returning lost items, and incentives for recovering overdue debts.
The research demonstrates that these applications comply with the Shariah controls of Ju'alah if the conditions are met, including the lawfulness of the task, clarity of the reward, and the absence of gharar (excessive uncertainty) and riba (usury/interest). The significance of Ju'alah lies in being a flexible financing tool that stimulates creativity and innovation, offering a practical Shariah-compliant alternative to many contemporary incentive systems, thereby affirming the ability of Islamic law to keep pace with modern developments in economics, technology, and scientific research.
