الإفراج المشروط في التشريع الجزائري

Abstract

إن الإفراج المشروط نظام تعددت مفاهيمه وتعاريفه منذ ظهوره إلى أن وصل إلى المفهوم الحديث وذلك تحت تأثير مجموعة من المفاهيم الجديدة وكذا التغيرات الحاصلة في الدول والمجتمعات والأنظمة القانونية، بالإضافة إلى تميزه على الأنظمة المشابهة له، أما بالنسبة للتكييف القانوني للإفراج المشروط يرتبط ارتباطا وثيقا بطبيعة السلطة مصدرة القرار، كما أن نظام الإفراج المشروط يرتب آثارا قانونية، حيث لم يعد وسيلة لتخفيف العقوبة بل أصبح نظاما لوقف تنفيذها مؤقتا، وأما بالنسبة لانتهاء الإفراج المشروط الذي يكون بانقضاء فترته دون إخلال المفرج عنه بالالتزامات المفروضة عليه وبالتالي يتحول إلى إفراج نهائي، أما في حالة إخلاله يترتب على ذلك إلغاء قرار الإفراج المشروط وعودته للمؤسسة العقابية لإكمال ما تبقى من مدة العقوبة مع احتساب فترة الإفراج المشروط. الكلمات المفتاحية : انظام الافراج المشروط – التكييف القانوني – المفرج عنه – قرار الافراج Abstract : Conditional release is a system whose concepts and definitions have multiplied since its inception until it reached the modern concept, under the influence of a group of new concepts as well as changes in countries, societies and legal systems, in addition to its distinction over similar systems.
