الحقوق المادية للمطلقة في قانون الأسرة الجزائري والاجتهاد القضائي

Abstract

اعتبر الإسلام الزواج الوسيلة الصحيحة لتكوين الأسرة، فيه تعرف الأنساب وتحفظ وبه تصان الأعراض وتقل الفاحشة، وخصت الشريعة الإسلامية الأسرة بوافر، إلا أنه قد تسوء العشرة الزوجية ويشتد الخلاف بين الزوجين فيفقد الزواج معانيه السامية، ولا يبقى أمام الزوجين سوى فك الرابطة الزوجية، ومن هذا المنطلق أجازت الشريعة الإسلامية الطلاق ولكن وفق ضوابط شرعية، وعمل بما جاءت به الشريعة الإسلامية فقد أقر المشرع الجزائري الطلاق ونظمه بمجموعة من الأحكام الواردة في قانون الأسرة. وبمجرد الوقوع في الطلاق بين الزوجين تنشأ عنه عدة آثار والتي يمكن تقسيمها إلى آثار مالية التي تتجلى في النفقة، النزاع حول متاع البيت والتعويض.
