Abstract
Abstract:
This research investigates "The Causes of Juristic Disagreement (*Ikhtilaf*) according to Imam Ibn Bashir through the book *Al-Tanbih 'ala Mabadi' al-Tawjih* - The Book of Fasting (*Kitab al-Siyam*) as a Model," aiming to highlight the applied impact of foundational (*Usuli*) and juristic (*Fiqhi*) maxims in directing juristic disagreement (*Tawjih al-Khilaf*) and deconstructing the structure of legal reasoning (*Istidlal*) among Maliki scholars. Structured into two main parts, the study first establishes a theoretical foundation by defining relevant terminology, distinguishing between strict divergence (*Khilaf*) and valid disagreement (*Ikhtilaf*), and tracing the historical evolution of disagreement from the Prophetic era to the time of the Four Imams. It also reviews the types, rulings, and general causes of disagreement among jurists (*Fuqaha*), alongside a comprehensive biography of Imam Ibn Bashir and an introduction to his seminal work. Building on this framework, the applied analytical section systematically extracts the causes of disagreement within the "Book of Fasting," classifying them into foundational (*Usuli*) causes—such as addressing non-Muslims with the branches of Islamic law (*Khitab al-Kuffar bi Furu' al-Shari'ah*), taking disagreement into consideration (*Mura'at al-Khilaf*), the extended obligation (*Al-Wajib al-Muwassa'*), and omitting detailed inquiry in the context of reporting (*Tark al-Istifsal fi Maqam al-Hikayah*)—as well as juristic (*Fiqhi*) causes grounded in universal maxims (*Qawa'id Fiqhiyyah*), including the presumption of continuity (*Istishab Halayn*), testimony implications, the principle that hardship begets ease (*Al-Mashaqqah tajlib al-Taysir*), and considering the rare occurrence (*Mura'at al-Nadir*). Ultimately, by analyzing each *Fiqhi* issue as presented by Ibn Bashir and tracing it back to its underlying orientational cause, the methodology effectively demonstrates the profound connection between the foundational theoretical structure (*Al-Bina' al-Qa'idi*) and the practical juristic outcome (*Al-Thamarah al-Fiqhiyyah*).
