Abstract

تعتبر الصفقات العمومية من أهم العقود التي تعرف مرحلة إنشائها وتكوينها تأطيرا قانونيا كثيفا، وهي من أهم التصرفات القانونية التي تبرمها الإدارة من اجل ممارسة مهامها في إشباع الحاجات العامة، وتكوين الصفقات العمومية يحتوي عملية مهمة تتمثل في المرحلة التحضيرية للصفقات العمومية. لهذا سعى المشرع لوضع إجراءات متعددة، من اجل تجسيد نجاعة الطلب العمومي والاستعمال الجيد للمال العام، وهذا عن طريق إلزام المصالح المتعاقدة بتحديد الحاجات العمومية وتنسيقها، وتحصيصها، والقيام بالدراسات الأولية، والتأكد من توافر الاعتماد المالي، ثم القيام بإعداد دفتر الشروط قبل أن تقوم بمباشرة الدعوة للتعاقد، هنا تتبين الأهمية الكبيرة لهذه المرحلة في إضفاء الشفافية على إبرام الصفقات العمومية، وحماية المنافسة والحد من ظاهرة الفساد. الكلمات المفتاحية: الإجراءات التحضيرية،الصفقة العمومية،التعاقد، حماية المال العام،الفساد. Summary: Public procurement are among the most important contracts that know the stage of their establishment and composition in a highly legal framework, it is one of the departments most important legal actions to exercise its functions in satisfying public needs, the composition of public transactions contains an important process of preparatory phase of public procurement. That is why the legislator sought to establish multiple procedures, in order to reflect the effectiveness of public demand and the good use of public money, this is by obliging contracting interests to identify and coordinate public needs, and allocate, doing preliminary studies, ensure that the financial credit is avaible, then set up the terms book before you proceed with the invitation to contract, here is the great importance of this phase in making public transactions transparent, competition protection and reduce corruption.
