خصوصية الشرط التعسفي ومدى تأثيره على العقد الاستهلاكي

Abstract

يتوقف تحديد نطاق عقود الاستهلاك وطبيعة الشروط التي تتضمنها على صفة أطراف العلاقة التعاقدية وما يتميز به كل طرف من ضعف وحاجة أو قوة ونفوذ ما يجعلها تتصف بعدم التوازن العقدي الذي استفحل خاصة مع ظهور الحركة الصناعية وتنوع السوق بين العادية والالكترونية وضرورة السرعة في إبرام الصفقات ما ساهم في بروز العقود النموذجية المحررة مسبقا من الطرف المسيطر على العقد بشروط تعسفية تثقل كاهل المتعاقد الضعيف وهو ما استوجب ضرورة التدخل لحمايته من مثل هذه التعاقدات لذا جاء المشرع بعدة آليات غير أن هذه الحماية لا تتحقق إلا إذا اقترنت بالجزاء. الكلمات المفتاحية: خصوصية -الشرط التعسفي -العقد - العقد الاستهلاكي.
