تعسف الزوجة في استعمال الحق -الخلع نموذجا- دراسة مقارنة

Abstract

يعالج هذا البحث موضوع: "تعسف الزوجة في استعمال الحق الخلع نموذجا –دراسة مقارنة- "، من خلال تطبيق نظرية التعسف في استعمال الحق بمعاييرها على ممارسة الزوجة لحقها في الخلع والتعسف في هذا الحق مع بيان صور وأنواع هذا التعسف، وما يترتب على ذلك من آثار سواء من جهة الزوج أو من جهة الزوجة، مع إبراز موقف كل من الفقه الإسلامي والقانون الجزائري من ذلك. وقد خلص هذا البحث إلى أن المشرع الجزائري قد خطى خطوات لأجل الحفاظ على العلاقات الزوجية من التعسف، إلا أنه ما يزال قاصرا عن مواكبة أحكام الشريعة الإسلامية في هذا الباب. Research Abstract: This study examines the issue of "The Wife’s Abuse of the Right to Khula: A Comparative Study" by applying the theory of abuse of rights and its legal standards to the wife’s exercise of her right to initiate khula. It identify the forms and types of abuse that may occur in this context, and explores the legal and social consequences for both the husband and the wife, The study also highlights the respective positions of Islamic jurisprudence and Algerian law on this matter. The research concludes that, while the Algerian legislature has taken steps toward safeguarding marital relationships from abuse, it still falls short of fully aligning with the principles and rulings of Islamic Sharia in this domain.
