Research Summary This research demonstrates that the judiciary in Islam is considered one of the greatest legal authorities entrusted with preserving rights, establishing justice, and resolving disputes according to the principles of Islamic law. The judicial system received significant attention since the time of the Prophet Muhammad ﷺ, as the Prophetic Sunnah laid the foundational principles of a judicial system based on justice, equality, and the realization of public interest. The study also shows that the Rightly Guided Caliphs followed the Prophetic approach in developing and organizing the judiciary. They worked to strengthen the principles of justice, appoint qualified judges, and ensure judicial independence, while exercising ijtihad in addressing new and emerging cases in accordance with the objectives of Islamic law. The era of Caliph Umar ibn Al-Khattab رضي الله عنه particularly stood out in the development of the judicial system through organizing judicial administrations, appointing judges, and establishing regulations that guaranteed the integrity and independence of the judiciary, making his period a model for judicial administration. The research further explains that the judicial ijtihads of the Rightly Guided Caliphs were not merely individual opinions, but were founded upon solid Islamic legal sources derived from the Holy Qur’an, the Prophetic Sunnah, consensus (Ijma‘), and analogy (Qiyas). This made their rulings an important source in the formation and development of Islamic jurisprudence throughout history. Moreover, the study highlights the importance of legal maxims in achieving justice, such as the rule: “The burden of proof is upon the claimant,” and the principle: “Hudud punishments are averted in cases of doubt,” due to their role in protecting rights and safeguarding society from injustice and arbitrariness. The research concludes that the Islamic judicial system during the era of the Rightly Guided Caliphs was characterized by comprehensiveness, flexibility, and balance between religious texts and public interests, which confirms the suitability of Islamic law for all times and places. In conclusion, the study of judicial jurisprudence and the ijtihads of the Rightly Guided Caliphs reveals the greatness of Islamic legislation and the nobility of its objectives in achieving justice and social stability. It also emphasizes the importance of benefiting from these principles in addressing contemporary judicial issues and developing modern legal systems. | |
