عمل أهل المدينة في فتاوى الإمام مالك من خلال كتاب البيان والتحصيل لابن رشد الجد - نماذج مختارة-

Abstract

يهدف هذا البحث إلى بيان أهمية أصل عمل أهل المدينة وأنه أصل معتمد من أصول المذهب المالكي، وذلك بذكر مفهومه وبعض المصطلحات التي يعبر عنها على عمل أهل المدينة وأنواعه وحجيته، كما يتناول هذا البحث عرض نماذج تطبيقية لهذا الأصل من خلال كتاب البيان والتحصيل لابن رشد الجد -رحمه الله- والتي اشتملت على فتاوى الإمام مالك -رحمه الله- التي خرجها على أصل عمل أهل المدينة، وانتقيت منها نماذج مختارة من بابي العبادات والمعاملات، حيث تبين لي أنه أصل من أصول الإمام مالك -رحمه الله- يعمل به ويأخذ به في كثير من المسائل ويقدمه أحياناً على خبر الواحد، لأن العمل لديهم هو رواية جمع غفير نقلوها جيلاً عن جيل فصار بمنزلة المتواتر، وفي المدينة نزل الوحي واستقر التشريع. الكلمات المفتاحية: عمل أهل المدينة، الإمام مالك، ابن رشد، البيان والتحصيل، فتاوى الإمام مالك. Abstract: This research aims to demonstrate the importance of the principle of the Practice of the People of Madinah and that it is a recognized source among the foundations of the Maliki school of thought. This is done by explaining its concept, some of the terms used to refer to it, its types, and its authoritative value. The research also presents practical examples of this principle through the book Bayān wa al-Taḥṣīl by Ibn Rushd al-Jadd, which includes the fatwas of Imam Malik that were based on the principle of the Practice of the People of Madinah. I selected examples from the chapters of acts of worship and transactions. It became clear to me that this principle is one of the foundations adopted by Imam Malik, which he applied and relied upon in many issues, sometimes even giving it precedence over solitary reports (khabar al-wāḥid), because the practice of the people of Madinah was transmitted by large groups generation after generation, thus attaining the level of mutawātir transmission. Moreover, Madinah was the place where revelation descended and Islamic legislation became established.
