طلاق السكران في الفقه الإسلامي والقوانين الوضعية – دراسة مقارنة

Abstract

جعلت الشريعة الإسلامية الطلاق وسيلة مشروعة لحل الرابطة الزوجية التي لم يقدر لها إستمرار، كما ميز الله الإنسان على سائر مخلوقاته بالعقل، فحرم كل ما يذهبه وعاقب عنه وزجر، والسكران قد تصدر منه أقوال وأفعال حال سكره ومن ذلك لفظ الطلاق وهذا ما تناولته في بحثنا طلاق السكران في الفقه الإسلامي والقوانين الوضعية نبين من خلالها آراء الفقهاء وعرض أدلة التي استدلوا بها وما نوقشت مستخرجين الرأي الراجح وكذا بيان موقف بعض القوانين الوضعية من هذا الطلاق الكلمات المفتاحية: طلاق. السكران. السكر. الفقه الإسلامي. القوانين الوضعية

Abstract Islamic Sharia has established divorce as a legitimate means to dissolve a marital bond that can no longer continue. Furthermore, God has distinguished human beings from the rest of His creation with intellect; therefore, He has strictly prohibited everything that impairs it, imposing punishments and deterrents against it. An intoxicated person may utter words and commit actions while in a state of drunkenness, including the pronouncement of divorce. This is what we have addressed in our research, titled "The Divorce of the Intoxicated Person in Islamic Jurisprudence and Positive Laws." Through this study, we clarify the views of Islamic jurists, present and discuss the evidence they relied upon to deduce the preponderant opinion, and explain the stance of certain positive laws regarding this type of divorce.
