Abstract

Summary :
Our memorandum on the topic of confiscation and fines in Algeria during the Ottoman presence from 1518 to 1830 examines the issue of whether the policy of confiscation and fines was a tool for administrative and economic control of Algeria during the Ottoman presence from 1518 to 1830. We have concluded that confiscation is the seizure by the state of all or part of the income or property obtained by a person. It has taken on multiple concepts despite being a punitive and precautionary measure, as it was used to express various meanings such as causes, remnants, bequests, sale, and sometimes took on the meaning of the fine itself. As for fines, it is an exceptional tax paid by the inhabitants to the state, varying according to the regions of the country.
The legal basis for confiscation goes back to the provisions of Islamic Sharia in general, and in Algeria, its basis can be found in a fatwa issued by Mufti Bahjat Abdullah to justify the actions of Sultan Ahmed III (1703-1730 AD). As for the legal ground, it does not rely on any explicit legal text, as no text or decree concerning confiscation has been established.
And the implementation of confiscation and fines was not subject to the whims of the rulers, as some historical writings that seek to distort the history of Algeria suggest. Although its aim was to enrich the treasury and pay soldiers' salaries, it was based on many legal, political, economic, administrative, and even ethical reasons.
It also did not target a single category, but rather included multiple segments of society, including rulers, officials, scholars, and even individuals, merchants, and rebellious tribes, despite the differences between one category and another.
It left behind confiscations and fines that had a significant impact on the population and the state, affecting various political, economic, and social fields, as one can distinguish between positive effects such as ensuring the unity of the state, enriching the treasury, and paying soldiers' salaries, and other negative effects such as the emergence of revolts and rebellions, disobedience, a decline in living standards, and the disappearance of property.
