منازعات الحضانة في قانون الأسرة الجزائري

Abstract

هذه الدراسة إلى تحقيق مجموعة من الأهداف نلخصها في النقاط التالية، حماية مصلحة الطفل وتوفير بيئة صالحة لنموه وتنميته السليمة، وحقيق المساواة بين الوالدين فيما يتعلق بحقوقهما وواجباتهما تجاه الأطفال، بالإضافة الى توفير الاستقرار والسلام الأسري للأطفال الذين يعانون من منازعات الحضانة، وتنظيم الإجراءات القانونية والإجراءات القضائية المتعلقة بقضايا الحضانة لضمان العدالة والشفافية. كما خلصت الدراسة الى تحديد الأسس القانونية والإجرائية المتعلقة بالحضانة في التشريع الجزائري، وتوضيح حقوق الطفل والوالدين في قضايا الحضانة والتزامات كل طرف، بو أيضا تحديد المعايير التي يستند إليها القضاة لاتخاذ قراراتهم في قضايا الحضانة، وفي الأخير تحليل التحديات والصعوبات التي تواجه الأسر المنفصلة في الوصول إلى اتفاق بشأن الحضانة.

Abstract This study aims to achieve a set of objectives summarized in the following points: protecting the interests of the child and providing a conducive environment for their proper growth and development, ensuring equality between parents regarding their rights and responsibilities towards the children, in addition to providing stability and familial peace for children experiencing custody disputes, and organizing the legal and judicial procedures related to custody cases to ensure justice and transparency. The study also concluded by identifying the legal and procedural foundations related to custody in Algerian legislation, clarifying the rights of the child and the parents in custody matters, and the obligations of each party. It also identified the criteria on which judges rely to make their decisions in custody cases. Lastly, it analyzed the challenges and difficulties faced by separated families in reaching agreements regarding custody.
