Abstract

إن التحكيم التجاري الدولي هو بلا شك قضاء أصيل , حيث احتبل في وقتنا الحاضر مكانة متميزة وخاصة كوسيلة لفض النزاعات المترتبة على عقود التجارة الدولية , ولعل أهم أسباب نجاح التحكيم التجاري الدولي , باعتباره طريق غير عادي لفض النزاعات الناشئة بين المتعاملين الاقتصاديين بخصوص معاملاتهم التجارية , لا يمكن فقط في تلك المزايا التي يوفرها لهم , وإنما بسبب الدور البارز الذي تلعبه ارادة هؤلاء في إجرائه . الكلمات المفتاحية دور الإرادة ، التحكيم التجاري الدولي ، التشريع الجزائري
