العُرْفُ وَأَثَرُهُ فِي الفِقْهِ الإِسْلَامِيّ - بَابُ المُعَامَلَات نَمُوذَجًا -

Abstract

تناول هذا البحث موضوعا بعنوان "العُرف وأثرُه في الفقه الإسلاميّ – بَابُ المُعَامَلَاتِ نَمُوذَجًا –"، مُنطلقا من إشكاليّة رئيسيّة، كانت كالآتي: ما مدى اعتبار العرف كمصدر للتشريع؟ وما مدى تأثيره على الأحكام الفقهية المتعلّقة بمسائل الأحوال الشّخصيّة والمعاملات الماليّة؟ وللإجابة عن هذه الإشكاليّة قسّمنا البحث إلى فصلين؛ الفصل الأوّل: هو فصل نظريّ تأصيليّ، تناولنا فيه العرف كمصدر من مصادر التّشريع، من خلال تعريفه وتمييزه عن المصطلحات المشابهة له، وبيان أقسامه، وأدلّة حجيّته، وشروط اعتباره، ومجالات إعماله. والفصل الثّاني تطبيقيّ تناولنا فيه أثر العرف في مجال المعاملات. وتوصّلنا من خلال هذا البحث إلى جملة من النتائج والتّوصيات أوردناها في الخاتمة. This research addresses a topic entitled "Custom and its Impact on Islamic Jurisprudence - Transactions as a Model", based on the following main question: To what extent is custom considered a source of legislation? And to what extent does it influence the jurisprudential rulings related to matters of marriage and financial transactions? To address this question, we divided the research into two sections: The first section is a theoretical and foundational section, in which we addressed custom as a source of legislation. We defined it, distinguished it from similar terms, and explained its categories, the evidence for its validity, the conditions for its consideration, and the areas of its application. The second section is a practical section, in which we addressed some forms of considering custom in transactional matters. Through this research, we reached a set of findings and recommendations, which we present in the conclusion.
