سلطات الولي في ادارة اموال القاصر

Abstract

أستحدث نظام الولاية على مال القصر بهدف حماية مصالحهم المالية من طمع الغير فيها ، يكون ذلك من خلال تعيين ولي يتكفل بالتصرف في أمواله و إدارتها ، على أن يتحمل هذا الأخير نتيجة الأضرار التي قد تلحق بمصلحة القاصر المالية بسبب تصرفاته ، لذلك وضع قانون الأسرة قيودا و ضوابط تحد من السلطة المطلقة للولي أين أخضع تصرفاته لرقابة القاضي من خلال آلية الإذن القضائي، و يمكن للقاضي بموجب تلك السلطة أن يقوم بوقف الولاية لتعارض مصالح الولي مع مصالح القاصر، و له أن يعزله عن مهامه ، إذا ثبت أن تصرفاته تهدد مصلحة القاصر. و قد تنتهي الولاية على المال أيضا بموته أو فقدان أهليته أو ببلوغ القاصر سن الرشد ، ترشيده أو موته.

Abstract: The system of guardianship has been introduced to preserving the property of minors and protecting their financial interests from the greed of others. This is done by assigning a guardian to dispose of and manage his funds, and he bears the result of the damage that may be caused to the financial interest of the minor as a result of his actions, For this reason the family law has established restrictions and controls that limit the absolute authority of the Guardian where his actions are subject to the control of the judge through the judicial permission mechanism. Judge under that authority can stop the guardianship over the money because the interests of the Guardian conflict with the interests of the minor, he has the power to remove him from his duties, if he finds that his actions threaten the interest of the minor. The Guardianship over the money can also lapse because of his death, losing of his capacity. Or by reaching the legal age of majority, emancipation, death of a minor.
