Abstract

يعالج هذا البحث موضوع مقاصد الأسرة عند الإمام ابن عاشور من خلال دراسة تجمع بين التأصيل النظري والتطبيق المقاصدي لأحكام العائلة في الشريعة الإسلامية، فقد خصص الفصل الأول لبيان الإطار المفاهيمي للبحث، حيث تناول تعريف مقاصد الشريعة ونشأتها وتطورها عبر المدارس الأصولية، مع إبراز مكانتها في الاجتهاد الفقهي وأثرها في تجديد الفكر الإسلامي المعاصر، ثم عرف بالإمام ابن عاشور وحياته العلمية ومنهجه المقاصدي، إضافة إلى توضيح مفهوم العائلة ومكانتها في فكره باعتبارها أساس الاستقرار الاجتماعي والأخلاقي، أما الفصل الثاني فقد تناول المقاصد التفصيلية لأحكام الأسرة، فدرس مقاصد رابطة النكاح وما تحققه من سكن ومودة وحفظ النسل، ثم تطرق إلى مقاصد انحلال الرابطة الزوجية من طلاق وخلع وتفريق للضرر باعتبارها وسائل شرعية لرفع الحرج، ودفع الضرر، وتحقيق التوازن الأسري، كما تناول مقاصد روابط النسب والصهر وما تؤديه من حفظ للأنساب وتقوية للروابط الاجتماعية، مع بيان صور انحلالها وآثارها، ليخلص البحث إلى أن منهج ابن عاشور المقاصدي يبرز البعد الإصلاحي والإنساني للتشريع الأسري، ويؤكد أن أحكام الأسرة في الإسلام قائمة على تحقيق المصالح وصيانة كرامة الانسان واستقرار المجتمع . الكلمات المفتاحية: مقاصد الشريعة، الإمام ابن عاشور، منهجه المقاصدي، مقاصد أحكام العائلة= الملخص بالإنجليزية: This research examines the objectives of the family according to Imam Ibn Ashur through a study that combines theoretical foundations with the maqāṣid-based application of family rulings in Islamic law. The first chapter is devoted to presenting the conceptual framework of the study. It discusses the definition of the objectives of Islamic law (Maqāṣid al-Sharīʿah), their origins, and their development across different schools of legal theory, while highlighting their significance in juristic reasoning and their role in renewing contemporary Islamic thought. The chapter also introduces Imam Ibn Ashur, his scholarly life, and his maqāṣid-oriented methodology, in addition to clarifying the concept of the family and its importance in his thought as the foundation of social and moral stability. The second chapter addresses the specific objectives underlying family rulings. It examines the objectives of the marital bond and the values it achieves, such as tranquility, affection, and the preservation of lineage. It then discusses the objectives of the dissolution of the marital relationship, including divorce, khulʿ, and judicial separation due to harm, considering them legitimate means for removing hardship, preventing harm, and maintaining family balance. The chapter also explores the objectives of kinship and affinity ties, their role in preserving lineage and strengthening social relations, and the forms and consequences of their dissolution. The study concludes that Ibn Ashur’s maqāṣid-based approach highlights the reformative and humanitarian dimensions of family legislation and confirms that family rulings in Islam are founded upon the realization of public and private interests, the protection of human dignity, and the stability of society.
