Abstract
this study focuses on the conditional release system as a pivotal mechanism for the
individualization of punishment, with a particular emphasis on the procedural updates
introduced by Law No. 25-14, amending and supplementing the Criminal Procedure
Code. The study aims to analyze the radical shift in the nature of conditional release from
an "administrative procedure" to a "judicial decision" issued by the Sentence
Enforcement Division, along with the resulting legal guarantees and the right to appeal.
The research examines the substantive and formal conditions for eligibility, highlighting
the vital role of technical and social bodies (both within and outside correctional
institutions) in assisting the convicted individual.
The study concludes that the "judicialization of sentence enforcement" under Law
25-14 is a significant step towards strengthening human rights; however, its practical
success remains dependent on the activation of aftercare programs and the coordination
of efforts between various ministerial sectors
