Abstract

موضوع عقد المرابحة في البنوك الإسلامية له أهمية كبيرة مما أدى الى الاهتمام الواسع بهذه المعاملة. فعقدت لدراسته المؤتمرات وأقيمت الندوات. وألفت فيه الكتب والرسائل الجامعية ومع ذلك لايزال مثار ليس في أوساط المتخصصين من الشرعيين والاقتصاديين فقط. بل على مستوى الجمهور العريض من المؤسسات والأفراد حيث يلجأ الكثيرون إلى المرابحة لتمويل مشروعاتهم أو لشراء حاجاتهم. وبدأنا الدراسة بفصل أول ذكرنا فيه الإطار المفاهيمي لعقد بيع المرابحة من خلال تعريف العقد والبيع والمرابحة وبينا مشروعية المرابحة وشروطها وخصائصها اما الفصل الثاني فذكرنا فيه أحكام المرابحة والتطبيق البنكي المعاصر. وختمنا هذا البحث بخاتمة لخصنا فيه أهم نتائج البحث و التوصيات

Webegan by studying the first chaper in whichwediscussedthe conceptual Framework for the murabahacontract by defining the contract, selling and clarifying the legitimacy of Murabaha, its conditions and characteristics.
