التنـازل عن حق الميـراث (التخارج)

Abstract

يهدف البحث إلى بيان أحكام التنازل عن حق الميراث (التخارج) في الشريعة الإسلامية ، وقد بينت في هذه الدراسة مفهوم التخارج ن ودليل مشروعيته ، وبيان الألفاظ ذات الصلة بمعناه ، والتكييف الفقهي له ، وثمرة الاختلاف في هذا التكييف ، ومن ثمة تطرقت إلى شروط صحة التخارج وطرق حل مسائله مع ضرب أمثلة على ذلك ، كما بينت مبررات نقض التخارج وخلصت إلى بيان أهمية التخارج في الحفاظ على العلاقات الأسرية وتلاحم المجتمع .

This research aims at defining the prescriptions for waiving the right of inheritance in the Islamic Sharia. Through this study, the author finds out the definition of Takharouj (wairer), the poof of its legality, the definition of the terms linked to its meaning, its jurisprudential adaptation and the fruit of the disagreement in adaptation. Consequently, we tackled the conditions of validity of Takharouj (wairer) and ways of resolving its issues by setting out examples. The paper states also justifications of denunciation of this Takharouj (wairer). Eventually, we pointed out the importance of this Takharouj (wairer) in preserving harmonious domestic relationships and maintaining the cohesion of society.
