اختيار الزوجة لموطن اقامتها في الفقه الاسلامي والقانون الوضعي

Abstract

يتناول هذا البحث موضوع اختيار الزوجة لموطن إقامتها في الفقه الإسلامي والقانون الوضعي، باعتباره من المسائل المهمة المرتبطة بتنظيم العلاقة الزوجية وتحقيق استقرار الأسرة، وتتمثل إشكالية البحث في بيان مدى حق الزوجة في اختيار موطن إقامتها، وحدود سلطة الزوج في تحديد محل السكن والضوابط الشرعية والقانونية المنظمة لذلك، ويهدف البحث إلى بيان مفهوم السكن الزوجي ومشروعيته، وتحديد موقف الفقه الإسلامي من حق الزوجة في اختيار محل إقامتها، ثم دراسة موقف القانون الوضعي، خاصة القانون الجزائري إلى جانب بيان موقف الاتفاقيات الدولية في هذه المسألة، كما يسعى البحث إلى إبراز أوجه التشابه بين الفقه الإسلامي والقانون الوضعي في تنظيم حق الزوجة في محل الإقامة.

This research addresses the topic of a wife's choice of her place of residence in Islamic jurisprudence and positive law, as it is one of the important issues linked to regulating the marital relationship and achieving family stability. The main research problem lies in clarifying the extent of the wife's right to choose her place of residence, the boundaries of the husband's authority in determining the housing location, and the legal and Sharia controls governing this matter. The research aims to clarify the concept of marital housing and its legitimacy, determine the position of Islamic jurisprudence regarding the wife's right to choose her residence, examine the stance of positive law—specifically Algerian law—alongside international conventions, and highlight the similarities and differences between Islamic jurisprudence and positive law in regulating the wife's right to a place of residence.
