الأصول الموهومة عند الإمام أبي حامد الغزالي رحمه الله

Abstract

تناولنا في موضوع بحثنا المسمى "الأصول الموهومة عند الإمام الغزالي رحمه الله" بعض الأدلة المختلف فيها التي وصفها الإمام الغزالي بالموهومة. وتطرقنا فيه إلى التعريف بالإمام الغزالي من خلال تتبع مسيرته الشخصية والعلمية. كما تطرقنا إلى تعريف الوهم، وتحديد ماهية الأصول الموهومة عند الغزالي. بحيث وجدنا انها تنقسم إلى أصول نقلية هي شرع من قبلنا، وقول الصحابي. وأصول عقلية تمثلت في الاستحسان والاستصلاح. حيث تناولنا ماهية هذه الأصول ومذاهب العلماء حول حجيتها مع عرض الأدلة، ومناقشتها والرد عليها، ثم بيان وجه الوهم فيها من وجهة نظر الإمام الغزالي، مع بيان الراجح من تلك المذاهب. وختمنا المباحث بالتطرق إلى الأثر الفقهي المترتب على الخلاف في تلك الأصول. لينتهي البحث بخاتمة شملت نتائج ما خلصنا إليه في دراستنا، وتوصيات تدعوا لمزيد من البحث العلمي في موضوع الدراسة. الكلمات المفتاحية : الأصول الموهومة – شرع من قبلنا – قول الصحابي – الاستحسان- الاستصلاح. Abstract: In our research titled "Illusionary Principles According to Imam Al-Ghazali, may Allah have mercy on him," we examined some of the disputed evidence that Imam Al-Ghazali described as "illusionary" (Wahoumah). We introduced Imam Al-Ghazali by tracing his personal and academic journey. Furthermore, we defined the concept of illusion and determined the nature of these illusionary principles according to him. We found that they are divided into transmitted principles, which include the laws of those who came before us (Shar' man qablana) and the statements of the Companions (Qawl Al-Sahabi), and rational principles, represented by juristic preference (Istihsan) and public interest (Istislah). We discussed the nature of these principles and the varying scholarly views regarding their authority, presenting, discussing, and refuting the evidence. This was followed by an explanation of the aspect of illusion in them from Imam Al-Ghazali's perspective, along with identifying the most preponderant (Rajih) views. We concluded the research by addressing the jurisprudential impact resulting from the disagreement over these principles. The study ends with a conclusion summarizing our findings and recommendations calling for further scientific research on the topic.
