الوصية بين الفقه والقانون

Abstract

اىتمت الشريعة االسالمية بالوصية ألنيا باب من أبواب الخير، تعود آثارىا عمى المجتمع، إذ تسود المحبة واإليخاء بين الناس ، وقد اىتم بيا المشرع الجزائري ونظميا في قانون األسر ة، وأوجد الوصية الواجبة وسماىا التنزيل. كل ىذا حماية ألحفاد الميت، إذا كان أبوىم قد مات قبل جدىم ، وقد سنتو أغمب التشريعات العربية وسمتو بالوصية الواجبة. الكممات المفتاحية : الوصية، أبواب الخير، المشرع الجزائري، الوصية الواجبة ، األحفاد، التنزيل Abstract: The Islamic sharia is concerned with the will because it is a door of good, its effects on society. Love and suggestion prevail among the people. Algerian legislature has taken care of it and regulated it in the family law, and has created the appropriate will and called it the download. All this is to protect the grandchildren of the house, if their father has died before, their grandfather, and most of the Arab legislation has enacted it and named it with due will.
