Abstract

تناولت هذه الدراسة موضوع "التعليلات المقاصدية للأحكام الشرعية في سورة النور من خلال التحرير والتنوير للشيخ الطاهر بن عاشور"؛ حيث تبلورت فكرتها العامة في الكشف عن الروابط الغائية بين الأحكام العملية ومقاصدها الكلية والجزئية. وتكمن إشكالية البحث في تساؤل محوري رئيس: " كيف صاغ الإمام ابن عاشور التعليلات المقاصدية للأحكام الشرعية في سورة النور من خلال كتابه "التحرير والتنوير" ؟ ". وتجلت أهم أهداف الدراسة في إبراز أسرار وحِكم التشريع الإسلامي في صيانة الأمن الأخلاقي، وحفظ الكليتين: العرض والنسل. ولتحقيق ذلك، اعتمد البحث على المنهج: الاستقرائي، والوصفي التحليلي، والاستنباطي، لتخلص إلى تأكيد مرونة الشريعة ومراعاتها لمصالح العباد في العاجل و الآجل. الكلمات المفتاحية: التعليلات المقاصدية؛ سورة النور؛ آيات الأحكام؛ التحرير والتنوير؛ ابن عاشور. Abstract: This study examines "The Maqasidi Explanations for Sharia Rulings in Surat Al-Nur Through Al-Tahrir wa al-Tanwir by Sheikh Al-Tahir Ibn Ashour." Its central idea revolves around uncovering the Maqasidi connections between practical rulings and their universal and specific objectives. The research problem lies in a central research question: "How did Imam Ibn Ashour formulate the Maqasidi explanations for Sharia rulings in Surat Al-Nur through his book Al-Tahrir wa al-Tanwir?" The study's main objectives lie in highlighting the wisdom and secrets of Islamic legislation in safeguarding moral security and preserving the two essential values of Chastity and Progeny. To achieve this, the research relied on the inductive, descriptive-analytical, and deductive approaches, concluding with an affirmation of Sharia's flexibility and its consideration of human interests in both this world and the hereafter.
