Abstract

تعد هذه الدراسة حصيلة جهد يهدف إلى التطرق إلى موضوع ذو طبيعة خاصة غير أن هذه الطبيعة تجعلنا نتوسع في البحث عن الحجز في النظام القانوني الجمركي ذلك حتى لا يبقى موضوع الحجز الجمركي من المناطق المحرمة التي يتجنب معظم الباحثين ودارسي القانون الخوض فيها. ورغم الصعوبات التي تعرضنا لها من خلال دراستنا لهذا الموضوع ذلك أنه تقني أكثر منه نظري، ونظرا لضرورة إلمامنا بجوانبه القانونية ولكنه لم يمنع أننا توصلنا من خلال دراستنا لهذا الموضوع إلى أن الحجز في القانون العام هو عبارة عن إستفاء لدين نظرا لعدم التزام المدين بأداء ه ولذلك كان إلزاما من تدخل السلطة في إطار ممارستها لحفظ الحقوق من الضياع التدخل عن طريق التنفيذ الجبري بواسطة الحجوز بمختلف أنواعها بتنظيم دقيقا لها لتحقيق التوازن المنشود بين طالب الحجز والمحجوز له. الكلمات المفتاحية: الحجز الجمركي، الحجز التحفظي Abstract This study is the result of an effort aimed at addressing a subject of a special nature.
