Abstract

يسلط هذا البحث الموسوم بـ "الأخذ بمفهوم كلام المجتهد وأثره في تقرير المسائل الفقهية -المدونة نموذجا-" الضوء على أهمية دلالات الألفاظ، وتحديدا "مفهوم المخالفة"، في استنباط الأحكام وتحرير المذهب المالكي. تتناول الدراسة في فصلها الأول التأصيل الأصولي لمفهوم المخالفة، مبينة حقيقته وأقسامه كالصفة والشرط، والشروط الصارمة لإعماله حماية للاستدلال من التشهي، مع استعراض الخلاف الأصولي حول حجيته بين المانعين كالحنفية والمثبتين من الجمهور. وينتقل البحث في فصله الثاني إلى الجانب التطبيقي، مبرزا منهج فقهاء المالكية في تنزيل أقوال المجتهد منزلة النصوص الشرعية عبر إخضاعها لقواعد الدلالة الأصولية. ومن خلال استعراض وتتبع تطبيقات فقهية متنوعة من كتاب "المدونة" في أبواب العبادات والمعاملات، تخلص الدراسة إلى أن توظيف مفهوم المخالفة ليس عملا عشوائيا، بل هو أداة منهجية دقيقة تعكس مرونة المذهب المالكي وقدرته على استيعاب النوازل، مؤكدة أن شخصية المجتهد تمتلك ملكة أصولية فذة قادرة على توليد الفروع الفقهية وتوسيع دائرة الاجتهاد من خلال الجمع الدقيق والتوفيق بين المنطوق والمفهوم. الكلمات المفتاحية: مفهوم المخالفة، المفهوم، المدونة، مالك، المجتهد.

Abstract: This research, entitled "Adopting the Concept of the Mujtahid's Speech and its Impact on Determining Fiqhi Issues - Al-Mudawwana as a Model," highlights the importance of semantic implications, specifically "Mafhum al-Mukhalafah," in deriving rulings and refining the Maliki Madhhab. In its first chapter, the study addresses the Usuli foundation of Mafhum al-Mukhalafah, explaining its essence, its categories such as condition and attribute, and the strict conditions for its application to protect the deduction process from arbitrariness, while reviewing the Usuli dispute regarding its authority between the objectors, like the Hanafis, and the proponents among the Jumhur. The research then moves in its second chapter to the practical aspect, highlighting the methodology of Maliki scholars in treating the statements of the Mujtahid similarly to Sharia texts by subjecting them to Usuli semantic rules. By reviewing various Fiqhi applications from the book "Al-Mudawwana" in the chapters of Ibadat and Mu'amalat, the study concludes that the employment of Mafhum al-Mukhalafah is not a random act, but rather a precise methodological tool that reflects the flexibility of the Maliki Madhhab and its capacity to accommodate Nawazil. It confirms that the Mujtahid's persona possesses an exceptional Usuli aptitude capable of generating Fiqhi branches and expanding the scope of Ijtihad through a precise combination and reconciliation between Mantuq and Mafhum.
