الترجيح بالمقاصد في بعض قواعد الأمـــر

Abstract

تهدف هذه الدراسة إلى إبراز دور المقاصد الشرعية ، كأداة حاسمة في ترجيح الأراء الأصولية، و الفقهية عند تعارض الأدلة في قواعد الأمر ، كالوجوب ، والفور ، و التراخي ، و غيرها ، حيث قسمت الدراسة إلى فصلين ، جانب نظري ، و آخر تطبيقي ، واعتمدنا في هذه الدراسة المنهج التحليلي و الإستقرائي ، لتأصيل حجية المقاصد كمرجح أصولي بارز ، و ربط ذلك بمسائل فقهية تثبت أثرها العملي ، و قد خلص البحث إلى أن إعمال المقاصد في صيغ الأمر ، يرفع التعارض الظاهري، و يجعل الأحكام أكثر رعاية لمصالح العباد. الكلمات المفتاحية : الترجيح بالمقاصد ، قواعد الأمر ، مقاصد الشريعة. ABSTRACT This study aims to highlight the role of sharia objectives (Maqasid al-Shari'ah) as a decisive tool in weighing and prioritizing (Tarjih) conflicting fundamental and jurisprudential opinions regarding the rules of divine command (Qawa'id al-Amr), such as obligation, immediacy, and others. The study is divided into two chapters: a theoretical framework and a practical, applied framework. In this study, we relied on both analytical and inductive methodologies to ground the authoritativeness of sharia objectives as a prominent fundamentalist weight-determining factor, linking this to jurisprudential issues that demonstrate its practical impact. The study concluded that applying sharia objectives to the formulations of divine command resolves apparent contradictions and renders legal rulings more attentive to the welfare and interests of people.
