ضوابط السلطة التقديرية للقاضي الجزائري في اسناد الحضانة

Abstract

تناولت هذه الدراسة موضوع السلطة التقديرية للقاضي الجزائري في إسناد الحضانة، إذ سمح بموجبها المشرع الجزائري للقاضي بأن يعمل سلطته التقديرية، وذلك استنادا بالاستناد على النصوص القانونية وبعض الآراء الفقهية. حيث جاء المشرع بنصوص تسعى للإلمام بظروف الطفل وحفظ حقوقه، وبالرجوع إلى القضاء نجد أن للقاضي سلطة تقديرية واسعة المجال في إسناد الحضانة، والمعيار الوحيد الذي يساعده في ذلك هو مراعاة مصلحة المحضون. بالإضافة فإنني استندت إلى الاجتهادات و القرارات القضائية في هذا المجال، وفي الأخير توصلت إلى نتيجة مفادها أنه من الضروري أن يتدخل لمراجعة الأحكام المتعلقة بالحضانة وتدارك النقائص الموجودةـ ومنحها المزيد من الأهمية التي تستحقها باعتبارها تمس بمصلحة المحضون. abstract: This study dealt with the subject of the discretion power of the Algerian judge in assigning custody. As the Algerian legislation allowed the judge to exercise his direction which based on the legal texts and some jurisprudence opinions. Where the Algerian legislator come up with legal provisions that understand and take care of the child's Circumstances and protect his rights and referring to the judiciary we find that the judge has an extensive direction in assigning custody and the only criterion that helps him is to take consideration the interest of kindergarten (child).

In addition, I referred to the judgments and decisions in this field. Finally, I find that it's obliged that the legislator have to intervenes to review the relevant provisions of custody and give them more importance, it deserves as affecting the interests of the child.
