ازدواجية الجزاء كآلية لحماية المستهلك

Abstract

بهدف حماية المستهلك، وباعتباره الطرف الضعيف في العلاقة التعاقدية الاستهلاكية، نحاول من خلال هذه الدراسة تسليط الضوء على حماية المستهلك في القانون الجزائري المتعلق بحماية المستهلك وقمع الغش والنصوص المنظمة لأحكام هذه الحماية لدى المشرع الجزائري،إذ نجد أن القانون رقم 09/03 ذو طابع تقني وظيفي يهدف لحماية فئة بعينها فئة المستهلكين أمام المتدخلين، وبما تضمنه من حقوق والتزامات ومدى فاعليتها في حماية المستهلك،وطابع جزائي كونه يرتب عقوبات جزائية عند مخالفة أحكامه عن طريق تحديد نطاق التجريم،وبالتالي تحقيق الأمان والحماية القانونية للمستهلكين في ظل هذه الإزدواجية من الجزاءات. الكلمات المفتاحية: المستهلك، المتدخل، الحماية، الجزاء SUMMARY
