Abstract

يتناول هذا البحث قاعدة “لا ضرر ولا ضرار” باعتبارها من القواعد الفقهية الكبرى في الشريعة الإسلامية، من خلال بيان حقيقتها وأدلتها ومكانتها وضوابط تطبيقها. ويهدف إلى إبراز دور هذه القاعدة في ضبط التطبيقات الفقهية القديمة والمعاصرة، وردّ الفروع والنوازل إلى أصولها الشرعية بما يحقق مقاصد الشريعة في رفع الضرر وتحقيق العدل وينقسم البحث إلى مدخل مفاهيمي يعرّف بالقواعد الفقهية وبالقاعدة محل الدراسة، مع بيان أنواع الضرر وضوابطه. ثم ينتقل إلى دراسة تطبيقاتها في فقه الأسرة في المسائل التقليدية مثل الهبة والزواج والطلاق والخلع، إضافة إلى النوازل المعاصرة. كما يتناول تطبيقاتها في المعاملات المالية، والمجال التربوي، ثم امتدادها إلى التطبيقات الطبية الحديثة، بمايعكس مرونة الفقه الإسلامي وقدرته على استيعاب المستجدات. الكلمات المفتاحية: القواعد الفقهية، قاععدة لا ضرر ولا ضرار، تطبيقات، الفقه الاسلامي. Abstract This research deals with the legal maxim “No harm and no reciprocating harm” as one of the major principles in Islamic jurisprudence, by explaining its definition, evidences, significance, conditions of application, and its relation to other legal maxims. It aims to highlight the role of this principle in regulating both classical and contemporary Islamic legal applications, and in addressing legal issues by referring them back to their foundational sources in order to achieve the objectives of Sharia, particularly the removal of harm and the establishment of justice. The study is divided into a conceptual introduction defining legal maxims and the maxim under study, along with the concept and types of harm. It then examines its applications in family law in both traditional cases such as gifts, marriage, divorce, and khul’, as well as contemporary issues. Furthermore, it explores its applications in financial transactions, educational contexts, and modern medical cases, reflecting the flexibility of Islamic jurisprudence in addressing evolving realities.
