Abstract
This study aims to highlight the legal and institutional framework governing investment in desert
agriculture in Algeria and to assess the effectiveness of legislation in achieving a balance between
encouraging investment and enhancing food security on the one hand, and protecting agricultural land
and meeting the requirements of sustainable development on the other. The study adopted the
analytical approach through the examination of relevant legal and regulatory texts and was divided
into two chapters. The first chapter addressed the legal framework of agricultural investment,
mechanisms for the exploitation of agricultural land, the role of the Office for the Development of
Industrial Agriculture in Saharan Lands (ODAS), and the incentives introduced by Investment Law
22-18. The second chapter focused on the prospects for developing desert agriculture through smart
farming and agricultural technology, while highlighting the major natural, financial, and logistical
challenges, in addition to presenting some successful experiences in southern Algeria. The study
concluded that the Algerian legislator has provided significant legal incentives; however, investment
still faces financial and technical difficulties, which requires the development of financing
mechanisms, the strengthening of digitalization, and the expansion of smart irrigation techniques and
renewable energy use to ensure the sustainability of water resources.
