الإجراءات الوقائية لمكافحة الفساد في مجال الصفقات العمومية

Abstract

يعد الفساد في مجال الصفقات العمومية من أخطر أشكال الفساد نظرا لارتباطه الوثيق بالمال العام، الامر الذي أدي بالمشرع الجزائري الى وضع مجموعة من الإجراءات والاليات الوقائية لمكافحة هذه الظاهرة والحد منها، والتي اجتهد على تكريسها و تجسيدها في أرض الواقع في صورتها الوقائية قبل وأثناء وبعد إبرام الصفقة ( مبدأ حرية الوصول للطلب العمومي ، مبدأ الشفافية ، مبدأ المساواة بين المتنافسين ) ، و تحديد إجراءات إبرام الصفقة (الإجراءات الشكلية ، الإجراءات الغير الشكلية ) ، و تحديد الحاجات تحديدا دقيقا قبل الدعوة إلى التعاقد ، و الاعداد المسبق لدفتر الشروط ، وصولا إلى فرض رقابة فعالة على إبرام الصفقة العمومية وهذا وفقا لما جاء به المرسوم الرئاسي رقم 15ـ274 المتضمن تنظيم الصفقات العمومية و تفويضات المرفق العام . الكلمات المفتاحية: ـ الفساد ـ الصفقات العمومية ـ الإجراءات الوقائية ـ أليات مكافحة الفساد ـ استدراج العروض ـ تحديد الحاجات ـ الاعداد المسبق لدفتر الشروط ـ الإجراءات الوقائية
