-الكلمات المفتاحية : الضرورة الطبية - المسؤولية الطبية - الفقه الإسلامي - القانون الجزائري - حفظ النفس - نقـــل الأعضاء - الإجهاض العلاجي. research Summary : This study explores one of the fundamental Islamic legal maxims : "Necessity overrides prohibition ," specifically its practical applications within the medical field. The research provides a comparative analysis between Islamic Jurisprudence and Algerian Law ( notably the Health Law 18-11 and the Penal Code), seeking to balance the preservation of the Higher Objectives of Sharia (preservation of life and progeny) with contemporary legal frameworks. The thesis is structured into two main chapters: a theoretical framework establishing the legal basis of necessity and its constraints , and a practical chapter addressing critical issues such as organ transplantation, limb amputation, therapeutic abortion, and artificial insemination. The study concludes that Algerian legislation is fundamentally aligned with Islamic principles, recognizing "medical necessity" as a ground for justification that absolves medical practitioners of liability. However , this is strictly governed by the rule that "necessity is determined by its extent," ensuring that the sanctity of the human body is only bypassed to the minimum degree required to save a life. Keywords : Medical Necessity.Medical Liability.Islamic Jurisprudence. Algerian Law . Preservation of Life . Organ Transplantation.Therapeutic Abortion
