Abstract

ملخص: تتناول هذه الدراسة الموسومة ب"أحكام التجنس بجنسية البلاد غير الإسلامية..دراسة تطبيقية، أحكام التجنس بالدرجة الأولى، وما يتبعها من إقامة وهجرة، وتناولت الموضوع في أربعة فصول، فصل تمهيدي، وفيه المقدمات الضرورية، والفصل الأول عن أقوال الفقهاء وأدلتهم التي كانت بين المنع والجواز، ثم الترجيح، مع بيان أدلة ذلك، وخلصت الدراسة إلى أن التجنس تعتريه الأحكام الشرعية الخمسة، الوجوب، والندب، والإباحة، والكراهة، والتحريم على حسب حال المتجنس والبلاد، والظروف المحيطة. وجاء الفصل الثالث لبيان الآثار المترتبة على التجنس، من الاندماج والولاء والبراء وأحكام القوانين المتعلقة بالتجنس والمواطنة أو الاندماج، ثم الفصل الرابع دراسة تطبيقية للمسلمين في أوروبا والمؤسسات الإسلامية، دراسة تطبيقية إحصائية كلمات مفتاحية: تجنس، أحكام، اندماج، إقامة، هجرة، بلاد غير إسلامية. Abstract This study, entitled "The Rulings on Naturalization in Non-Muslim Countries: An Applied Study," primarily addresses the rulings on naturalization, and its subsequent implications for residency and migration. It is divided into four chapters: an introductory chapter containing necessary preliminaries; the first chapter presents the opinions of Islamic jurists and their supporting evidence, ranging from prohibition to permissibility, followed by a preferred opinion and its supporting evidence. The study concludes that naturalization is subject to the five categories of Islamic legal rulings: obligation, recommendation, permissibility, reprehensibility, and prohibition, depending on the individual's circumstances, the country, and the surrounding conditions. The third chapter examines the consequences of naturalization, including integration, loyalty and disavowal, and the legal provisions related to naturalization, citizenship, and integration.
