Abstract

The study aims to analyze the principle of transparency in Algerian legislation in terms of its conceptual and legal framework, and to examine the mechanisms for its implementation within state institutions. It also highlights the main obstacles that hinder its effective application, whether political, legal, administrative, organizational, or related to the weakness of civil society. In addition, the study assesses the effectiveness of legal and regulatory texts in promoting transparency and their role in supporting good governance and participatory democracy, while presenting proposals to enhance transparency and strengthen oversight and accountability within the Algerian administrative and legislative system. The study concludes that, although transparency is formally enshrined in various constitutional and legal texts in Algeria, its practical application still faces significant challenges, including a limited legal framework, administrative complexity, weak citizen and civil society participation, and political factors affecting oversight mechanisms. Accordingly, the study recommends developing the legal framework, modernizing administrative systems, strengthening the independence of oversight bodies, and expanding civil society involvement to consolidate transparency as a cornerstone of the rule of law.
