الإعجاز التشريعي في نظام المواريث و الشبهات المثارة حوله

Abstract

في هذا البحث تطرقنا إلى موضوع الإعجاز التشريعي في علم المواريث باعتباره من أبرز مظاهر دقة الشريعة الإسلامية وشمولها، حيث جاءت أحكامه محكمة تراعي فطرة الإنسان، وتحقق التوازن بين الحقوق والواجبات. ويهدف البحث إلى إبراز جوانب الإعجاز في نظام المواريث من حيث دقته في تحديد الأنصبة، وعدالته في توزيع الثروات، ومراعاته لدرجات القرابة والحاجة، بما يحقق الاستقرار الأسري والتكافل الاجتماعي. كما يعالج البحث أهم الشبهات المثارة حول هذا النظام، خاصة ما يتعلق بدعوى عدم المساواة بين الرجل والمرأة، وذلك من خلال تحليل علمي وشرعي يبرز الحكمة من التفاضل في بعض الحالات، ويفند هذه الشبهات بالحجج العقلية والنقلية. ويخلص البحث إلى أن نظام المواريث في الإسلام يمثل نموذجًا فريدًا للإعجاز التشريعي لما يتسم به من دقة وعدالة وواقعية، وصلاحيته لكل زمان ومكان. الكلمات المفتاحية: الإعجاز التشريعي، علم المواريث، الشريعة الإسلامية، العدالة في توزيع الميراث، الأنصبة الشرعية، الشبهات حول المواريث. Abstract: Legislative miracle in the science of inheritance, considering it one of the most prominent manifestations of the precision and comprehensiveness of Islamic law. Its rulings came with wisdom that conforms to human nature and achieves a balance between rights and duties The study aims to highlight aspects of the miraculous nature of the inheritance system in terms of its precision in determining shares and its justice in the distribution of wealth, while taking into account degrees of kinship and need. This contributes to achieving family stability and social solidarity. The research also discusses the most important doubts raised about this system, especially those related to claims of inequality between men and women. It does so through a scholarly and rigorous analysis that reveals the wisdom behind differentiation in certain cases and refutes these doubts with rational and textual evidence. The study concludes that the inheritance system in Islam represents a unique model of legislative miracle due to its precision, justice, realism, and suitability for all times and places.
