Abstract This research aims to demonstrate how Islamic legal maxims (Al-Qawa'id Al-Fiqhiyyah) contribute to and are employed in establishing an integrated evaluation and Sharia-compliant protection of wealth. It seeks to transition financial matters from the state of fragmentation and jurisprudential inconsistency—caused by the branching of minor legal issues—into a tightly regulated organizational framework. Furthermore, it highlights the Sharia’s capacity to regulate and accommodate contemporary financial developments while protecting wealth from illicit gains. Through the theoretical grounding of the research topic and the analyzed case studies and applications, the study concludes that jurisprudential codification (Al-Taq'eed Al-Fiqhi) possesses a flexibility derived from the higher objectives of Sharia (Maqasid al-Sharia) and concise yet comprehensive expressions (Jawami' al-Kalim). Accordingly, the concept of wealth (Mal) expands to encompass physical assets, usufructs, and modern intellectual and moral rights in line with evolving custom ('Urf). Legal maxims also reaffirm a strict prohibition on wrongfully consuming people's wealth in all its modern forms and endorse the theory of objective liability (Dhaman), which mandates compensation immediately upon the occurrence of damage, regardless of legal capacity or intent. Additionally, they provide a mechanism for repentance and the purification of mixed funds containing illicit gains by expelling the tainted portion and directing it toward charitable causes. The ultimate practical and applied benefit of this research lies in providing a "regulatory and standardized framework" that offers realistic solutions to financial issues. It grants economists and researchers a flexible Sharia umbrella, enabling them to formulate modern financial literature, deconstruct the structure of emerging transactions, and adapt them jurisprudentially without the arduous task of searching through classical jurisprudence volumes. This ultimately ensures the preservation of rights, prevents disputes, and eliminates ambiguity (Jahalah). | |
