Abstract

Among the most important pillars of the state of law, rights and freedoms, is to ensure the supremacy of the constitution over all legal texts in the state, and this is evidenced by conforming all texts with the constitution, and the constitutional means in this is the principle of oversight over the constitutionality of laws, and the exercise of this oversight has been assigned to a constitutional body, which is The Constitutional Council, starting from the 1963 Constitution until the constitutional amendment of 2016. However, starting with the constitutional amendment of 2020, the Constitutional Council has been abandoned, and the trend towards assigning the task of protecting the constitution’s highness to the Constitutional Court, the latter has distinguished from the Constitutional Council by some characteristics related to its independence of membership, especially with regard to the mechanism adopted in selecting members, and the terms of membership. And guarantees of their exercise, and this is a guarantee of the existence of competencies and their independence in the exercise of their constitutional functions
