اجتهادات المذهب المالكي في باب الوقف وأثرها في قضايا الأوقاف المعاصرة -نماذج مختارة-

Abstract

تتناول هذه الدراسة معالم الاجتهاد الفقهي في المذهب المالكي بباب الوقف، وأثر توسعاته في معالجة القضايا المعاصرة. وتتمحور الإشكالية حول مدى مساهمة الخصوصية المالكية —كإجازة وقف النقود والتأقيت— في تقديم حلول تأصيلية للأوقاف المستجدة. ولتحقيق ذلك، اعتمد البحث المناهج: الوصفي التحليلي، والمقارن، والاستنباطي. وقد خلصت الدراسة إلى مرونة المدرسة المالكية وقدرتها على تفعيل الاستثمار التنموي المنتج عبر أوعية مستحدثة كالصناديق والأسهم الوقفية وضوابطها المعيارية، مِمّا يوفر بدائل تمويلية مستدامة تلبي المتغيرات الحديثة. الكلمات المفتاحية: الاجتهاد المالكي؛ الوقف النقدي؛ الوقف المؤقت؛ الصناديق الوقفية؛ المعايير الشرعية. This study examines jurisprudential reasoning (Ijtihad) within the Maliki school regarding Waqf, and its impact on addressing contemporary issues. The research problem centers on how the Maliki specificities—such as permitting cash and temporary Waqf—contribute to providing foundational Sharia solutions for emerging endowment practices. Adopting descriptive-analytical, comparative, and deductive methodologies, the study concludes that the Maliki school possesses a flexibility capable of activating productive developmental investment through modern vehicles like endowment funds and shares under Sharia standards, thereby providing sustainable financing alternatives that meet contemporary dynamics.
