تقديم البصمة الوراثية على اللعان دراسة فقهية قانونية مقاصدية

Abstract

يعد موضوع النسب من المواضيع ذات الأهمية البالغة، في ظل التشريعات العربية الإسلامية، لما له من ارتباط وثيق بجوانب دينية وأخلاقية واجتماعية متعددة. وقد أولتالدول العربية هذا الموضوعاهتماماًكبيراً،فنصّت عليه في تشريعاتها ومع التطورات العلمية الهائلة التي يشهدها العالم اليوم، ظهرت تقنية البصمة الوراثية التي أدت دورا محورياً في تحديد الهوية، هذا من خلال تحليل الحمض النووي. ويعتبر موضوع البصمة الوراثية منأدق المسائل المتصلة بإثبات النسب أو نفيه،الأمر الذي دفعنا فيهذا البحث تسليط الضوء على الوسائل الشرعية والقانونية لنفي النسبَ، واستعراض اختلاف آراء فقهاء الشريعة الإسلاميةورجال القانون، والإجتهادات القضائيةحول مدى الاعتماد على البصمة الوراثية في نفي النسب وتقديمها على اللعان بإعتبارها وسيلة علمية مستحدثة فرضها التقدموالتطور العلمي على النسب، في مقابل اللعان الذي يعد طريقاً شرعياً أصيلاً مستمداً من أحكام الشريعة الإسلامية. In light of Arab and Islamic legislation, the topic of lineage holds great importance due to its connection to religious, ethical, and social dimensions. This significance has prompted many Arab countries, particularly in the Levant region, to emphasize lineage in their legal systems and regulations. With the rapid scientific advancements witnessed globally-particularly in the field of genetic fingerprinting-new possibilities have emerged in determining lineage with high accuracy. Genetic fingerprinting has played a key role in this regard and has become a central topic in contemporary legal and jurisprudential discussions. Thisresearch explores the role of genetic fingerprinting in lineagedetermination through an analytical approach. Genetic testing isconsidered one of the most prominent modern scientific developments thathas influenced various aspects of Islamic jurisprudence, especially inmatters related to proving or denying lineage. This study highlights theextent to which DNA evidence can be adopted as a legitimate andreliable method in accordance with Islamic legal principles, while alsoconsidering the balance between scientific advancement and thefoundational objectives of Islamic law.
