نفقة المرأة العاملة في الفقه الإسلامي وقانون الأسرة الجزائري

Abstract

موضوع نفقة المرأة العاملة يعد من القضايا المستجدة التي أفرزتها التطورات وتغير الظروف والأعراف، بحيث أصبح العمل حقا مكفولاً للمرأة بنصوص من الدستور واتفاقيات حقوق الإنسان، وقد تناول الفقهاء نفقتها في حالات متعددة واختلفت أرائهم بين قائل بسقوط نفقتها وعدم سقوطها وأحياناً بتشطيرها أما قانون الأسرة الجزائري فلم يتطرق بصورة صريحة إلى نفقة المرأة العاملة، وإن كان قد أعطى للمرأة حق اشتراط العمل في عقد الزواج وبناءا على ذلك فقد قسمت هذه الدراسة إلى فصلين تناولت في الفصل الأول ماهية النفقة وهذا ببيان مفهومها ومشتملاتها، والفصل الثاني وتناولت فيه موقف الفقه الإسلامي وقانون الأسرة الجزائري من نفقة المرأة العاملة، وهذا ببيان شروط استحقاقها للنفقة ومدى سقوطها. The issue of the expenses of working women is one of the new issues that have been created by developments and changes in circumstances and customs, so that the work has become a guaranteed right for women in the provisions of the Constitution and human rights conventions. The scholars have dealt with their expenses in various cases. Their opinions differed between those who said that their expenses fell, and those who said that they did not fall, and sometimes they broke it. The Algerian Family law did not expressly mention the maintenance of working women, although it gave women the right to require work in marriage contract.Accordingly, this study was divided into two chapters: the first chapter dealt with nature of alimony and its concept and its components. The second chapter dealt with the position of Islamic jurisprudence and the Algerian family law on the expense of working women.
