Abstract

يعد نظام الأوامر الجزائية نظاما مهما في القضاء الجنائي، فهو يساهم في التوفيق بين مصلحة المجتمع وضرورة حمايته وبين مصلحة الفرد وحريته، حيث انه يوفر السرعة في التحقيقات ويراعي مبادئ الشرعية والمحاكمة العادلة، كما انه يساهم في تقليل الضغط على المحاكم والمجالس وتسهيل عملها، بالإضافة إلى انه يقلل النفقات، لذا فقد اعتمد عليه المشرع الجزائري بشكل موسع عبر مختلف مراحل الدعوى العمومية وهذا ما حاولنا بيانه من خلال هذه الدراسة. summary The criminal orders system is an important system in criminal justice, as it reconciles the interest of society with the need to protect it and shows the interest of the individual and his freedom, as it provides speed in investigations and takes into account the principles of legitimacy and fair trial, and it also contributes to reducing pressure on courts and councils and facilitating their work, in addition to it reduces expenses Therefore, the Algerian legislator has relied on it extensively throughout the various stages of the public prosecution, and this is what we have tried to explain through this study.
