مدى مشروعية استخدام الذكاء الاصطناعي بين الشريعة والقانون الوضعي

Abstract

إنّ الذكاء الاصطناعي باعتباره من أمهات القضايا البارزة في هذا العصر، عصر السرعة والتطور لما له من أثر واضح في واقع حياة الأفراد والمجتمعات ومن خلال ولوجه كل المجالات، ويعتبر استخدام الذكاء الاصطناعي الأصل فيه المشروعية متى كان جالبا للمصالح ودارء للمفاسد، وأن الشريعة الإسلامية والقانون الوضعي وإن كانا يلتقيان في بعض الجوانب المنظمة للذكاء الاصطناعي، إلا أن الشريعة الإسلامية ملمة بكل جوانب الموضوع وحيثياته من خلال ضوابطها الشرعية التي تمتاز بالعمق لا السطحية عكس القانون الوضعي. الكلمات المفتاحية: الذكاء الاصطناعي، الأتمتة ،الروبوتات، الذكاء الشريعة الإسلامية، القانون الوضعي. Abstract Artificial Intelligence (AI) is among the key core issues of our contemporary age, which is an age of rapid growth and acceleration, because of its tangible impact on people’s and societies’ lives and the way it permeates every aspect thereof. The use of artificial intelligence is generally considered acceptable when it helps produce public benefits and prevent any harm. While the overlap between Islamic Sharia and positive laws can be found in some aspects of the regulation of artificial intelligence, Islamic Sharia covers every aspect of artificial intelligence in full detail. The latter is made possible due to the divinely established legal limits of Islamic Sharia that have a lot of depth, unlike the limits of positive law.
