الحماية الجنائية للمال العام في القانون الجزائري

Abstract

إن الحماية الجنائية للمال العام والتي أقرها المشرع الجزائري توزعت نصوصها بين القانون 06-01 المتعلق بالوقاية من الفساد ومكافحته وكذا بين قانون العقوبات و القوانين المكملة له وهي آليات من شأنها الحفاظ على المال العام وحمايته غير أنه يجب مراجعة هذه النصوص للرفع من تكييفها القانوني من جنح إلى جناية كما هو حاصل في قانون الفساد المشار إليه آنفا وتشديد العقوبات المقررة لها لضمان أكبر قدر من الحماية للمال العام و ضمان الردع المناسب لمرتكبي هذه الجرائم.

Note summary The criminal protection of public funds, which was approved by the Algerian legislator, its provisions are divided between Law 01-06 related to preventing and combating corruption, as well as between the penal code and the laws that complement it, which are mechanisms that will preserve and protect public money. However, these texts must be reviewed to increase their legal adaptation and tighten penalties. Established to ensure the greatest degree of protection for public funds and to ensure appropriate deterrence for the perpetrators of these crimes
