جريمة القذف عبر مواقع التواصل الاجتماعي دراسة مقارنة

Abstract

تمثل جريمة القذف عبر مواقع التواصل الاجتماعي إساءة لاستخدام هذه المواقع لأغراض سلبية نتيجة قلة الوعي بالمخالفات القانونية المرتكبة، وبين الحرية المطلقة في التعبير والتعسف فيها، وذلك كون عنصر العلانية الذي تستوجبه واقعة القذف يتوافر بصفة مباشرة في مواقع التواصل الاجتماعي بمجرد نشرها، واكتمال أركان هذه الجريمة، والتي يتم تكييفها في التشريعات المقارنة والتشريع الجزائري من خلال النصوص التقليدية لجريمة القذف، وتختلف صور القذف فيها باختلاف محل القذف، بالإضافة إلى بساطة عقوباتها في التشريع الجزائري. الكلمات المفتاحية: مواقع التواصل الاجتماعي، جريمة القذف، التشريع الجزائري، التشريعات المقارنة. Summary: The crime of defamation through social media constitutes an abuse of these sites for negative purposes as a result of a lack of awareness of the legal violations committed, and between the absolute freedom of expression and abuse, because the element of publicity required by the fact of defamation is available directly on social media sites as soon as they are published, and the completion of the elements of this crime, which is adapted in comparative legislation and Algerian legislation through traditional texts of the crime of libel, and the images of defamation vary differently in the place of defamation, in addition to the simplicity of its punishments in Algerian legislation.
